ShouldIBreakUpWithHim.com (SIBUWH) is a Web site where visitors can post their dating and relationship issues and give advice on relationship issues to others. By using the SIBUWH Web site (the Site) you accept and agree to these Terms of Use (the Agreement), whether or not you register or post anything to the Site.

The following are the legally binding terms of your use of the Site. Failure to abide by them may result in your being barred from posting to the site or in legal action.

These terms may be modified by SIDHON at any time.

The Site is for the personal use of individuals only, not for any commercial uses. Collecting user names and/or email addresses of other visitors, by electronic or other means, for any reason—personal or commercial—is prohibited. Use of the site to send unsolicited commercial email or advertisements ("spam") is also prohibited.

You agree not to interfere with the operation of the site, damage or disable the site, or attempt to limit access to the site by any means whatsoever, including but not limited to viruses, harmful code, forged routing or denial of service attacks.

You understand and agree that SIBUWH may delete any posts without notice or explanation for any reason whatsoever, including those deemed offensive, inappropriate, irrelevant, illegal or that might threaten the safety of other visitors.

You are solely responsible for any material that you send to the site.

By submitting material to SIBUWH, you grant SIBUWH an irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to use, copy, display, transmit, perform and distribute all material submitted, in all media and formats now known or hereafter discovered, for any purpose, and to prepare derivative works of, or incorporate into other works, such material.

You may not include any last names, telephone numbers, street addresses, cities, URLs, email addresses or other details or characteristics that would identify yourself or anyone else in any material you submit to the site.

SIBUWH has the right to remove any identifying information from submitted material and to edit any material submitted so that it complies with these terms.

It is impossible to, and therefore we cannot, monitor the conduct of site visitors in the real world. You are fully responsible for any communication, in any medium and for any reason, that you have with any other site visitor.

SIBUWH is not responsible for any incorrect or inaccurate content posted to the Site, whether posted or caused by visitors, moderators or by any of the equipment or programming associated with the site.

SIBUWH assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication failure, theft, destruction or unauthorized access to, or alteration of, the Site, its content or the connections, service providers and equipment you use to access it.

The site is provided to you on an "as is" basis, with no warranties or representations, express or implied, including, without limitation, any warranty of merchantability, warranty of fitness for a particular purpose or warranty of noninfringement.

Under no circumstances will SIBUWH be responsible for any loss or damage resulting from anyone's use of the Site, any content posted or read, or any interactions between users, online or offline, including but not limited to any direct, indirect, incidental, special or consequential damages.

If there is any dispute about or involving the Site, you agree that the dispute will be resolved exclusively through binding arbitration, to be conducted in Burbank, California, by a single arbitrator, and by and in accordance with the commercial rules of the American Arbitration Association, except that SIBUWH will be entitled to seek injunctive or other equitable relief in the state and federal courts serving Burbank, California to prevent or stop any violation by you of any of the terms of this agreement or to prevent or stop any other violation or infringement of any right of SIBUWH, and you irrevocably submit to the personal jurisdiction of those courts. In the event of the resolution of any dispute by arbitration, the arbitrator's award may be entered in the highest court having jurisdiction.

This agreement and all disputes arising hereunder shall be governed by the laws of the state of California, without reference to its conflicts of laws principles. This agreement constitutes the entire agreement with respect to your use of the site.

You agree to indemnify and hold SIBUWH, its affiliates, officers, agents, partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your violation of this Agreement.

Privacy Policy

SIBUWH may send you email to let you know about new or upcoming site features, promotions or other news we think you might be interested in. If you don't want to receive those emails, you will have the opportunity to let us know that. SIBUWH may also send you occasional emails notifying you of important information, such as a change in the sites privacy policy or terms of use. We may do this whether or not you have opted to receive email or newsletters from us.

When you visit the site, your IP address and the site from which you came is automatically recorded, as it is with most Web sites. We may use this information to help diagnose any technical problems with the site and to enhance the site.

To operate the Site and fix any problems that arise, we may need to share your user name, password and/or email address with our service providers. We require these entities not to use your information for any purpose other than resolving the specific issue at hand.

SIBUWH and/or advertisers on the Site may place or read cookies on your computer. To disable them, the "help" section of your browser should explain how. But if you disable cookies, you may not be able to view some parts of the SIBUWH sites--and many other Web sites.

Your user name, password and/or email address may be passed on to a third party in the event of a transfer of ownership, of assets or in the case of bankruptcy. SIBUWH may also disclose this information if deemed necessary in order to comply with applicable law, cooperate with law enforcement or to protect the safety of other site visitors.
